Welcome to EasyPhoto, an AI-powered photo and image generation app. By accessing or using EasyPhoto, you agree to the following terms and conditions. Please read these terms carefully.

1. Introduction

EasyPhoto provides AI-powered tools, including Photoshoot AI, Image Generator, Upscale, and Cutout, to enhance and create personalized images. These Terms & Service (“Terms”) govern your use of EasyPhoto, accessible via the website at easyphoto.app and associated mobile applications.

2. Eligibility

Age Restrictions

  • Individuals under 16 years old are not permitted to use the service.

  • Users between 16 years old and the legal age of majority must have parental or guardian consent and supervision.

Prohibited Access

  • You may not use the service if:

    • You do not agree to these Terms.

    • You are not legally old enough to form a binding contract or lack parental/guardian consent.

    • Applicable laws in your location prohibit the use of the service.

3. Account Registration

  • To create an account, you must provide a valid email, a Google Gmail account, and your name.

  • You are responsible for maintaining the confidentiality of your login credentials.

  • Any misuse of your account, such as unauthorized access, may result in termination.

4. User-Generated Content

  • You are solely responsible for the content you upload, including headshots, prompts, uploaded images, and generated photos.

Content Usage

  • Photoshoot AI: Content is processed to generate personalized photos.

  • Image Generator: Prompts are used to create visuals.

  • Storage: Uploaded content (headshots, prompts, uploaded and generated images) is stored exclusively on your local device. We do not store this data on our servers.

  • Community Share: If you choose to share generated photos with the community, only those photos will be stored on our servers. These shared photos can be accessed by other users to generate similar results using their prompts and headshots.

5. Permitted Use and Restrictions

Acceptable Usage

  • Users can use Image Generator, Upscale, and Cutouts outputs for commercial purposes.

  • Photoshoot AI results are for personal use only and must feature your own photos.

Generations Limits:

  • Free Plan users are limited to 3 generations per day.

  • Basic and Pro Plan users are restricted to their respective monthly generation caps.

  • Pay-As-You-Go users are only limited by the credits purchased.

Prohibited Activities

  • Generating harmful, offensive, or copyrighted images.

  • Reverse-engineering the AI.

  • Attempting to bypass free image generation limits through excessive server usage.

As part of our commitment to maintaining a safe environment, EasyPhoto includes a safety filter during Photoshoot AI generation. The filter detects NSFW content (e.g., nude or semi-nude images) and replaces such content with solid black placeholders. Users are strictly prohibited from attempting to bypass or manipulate this safety feature.

While we strive to maintain the highest standards of filtering, this safety feature may occasionally fail. EasyPhoto does not guarantee the effectiveness of AI filtering in all cases and is not liable for any inappropriate content that may be generated as a result.

6. Privacy Policy

  • Uploaded content, including headshots, prompts, and generated images, is stored only on your local device.

  • Content shared with the community will be stored on our servers and made accessible for other users to generate similar results.

7. Payment and Subscription Terms

  1. Subscription Plans:

    • Free Plan: 3 free generations daily with limited access to features.

    • Basic Plan: $8 per month or $48 per year (50% discount). Includes 200 generations per month and access to all premium features.

    • Pro Plan: $32 per month or $192 per year (50% discount). Includes 1000 generations per month, access to all premium features, and priority processing.

  2. Pay-As-You-Go Credits:

    • Purchase credits for one-time usage of premium tools and features:

      • $10 for 100 Credits

      • $30 for 360 Credits (20% extra)

      • $50 for 900 Credits (80% extra)

    • Credits do not expire and can be used for all premium features with priority processing.

    • 1 Credit = 1 Generation.

  3. Auto-Renewal:

    • Subscription plans auto-renew unless canceled at least 24 hours before the end of the billing cycle.

    • Users can manage or cancel subscriptions via their respective app store accounts (Google Play).

  4. No Refunds:

    • Payments are non-refundable. If users choose to cancel, they will continue to have access to their plan benefits until the end of the current billing cycle.

8. Third-Party Tools and Services

EasyPhoto integrates with third-party technologies, including:

  • Stable Diffusion

  • Flux

We are not responsible for any issues arising from these third-party services.

9. Intellectual Property

  • Users retain ownership of the content they upload.

  • EasyPhoto retains ownership of all AI models and templates used in the app.

  • Generated content is licensed to you for personal or commercial use (as permitted above).

10. Liability and Disclaimers

  • EasyPhoto does not guarantee the accuracy or appropriateness of AI-generated outputs.

  • We are not liable for damages resulting from misuse of the app or its services.

  • Server interruptions or downtime may occur, and we are not responsible for these disruptions.

11. Termination

  • EasyPhoto reserves the right to terminate accounts for violations of these Terms.

  • Upon termination, access to your account and content stored in the app may be revoked.

12. Modifications to the Terms

We may update these Terms from time to time. Continued use of the app constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

Governing Law

These Terms & Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. However, as EasyPhoto is accessible worldwide, local laws applicable to your location may also govern certain rights and obligations related to your use of the app.

Dispute Resolution

In the event of a dispute, claim, or controversy arising out of or relating to your use of EasyPhoto, the following process will apply:

  1. Initial Resolution
    We encourage users to first contact our support team at [email protected] to attempt to resolve any issue informally.

  2. Mediation
    If the dispute cannot be resolved informally within 30 days, the parties agree to submit the matter to mediation under the rules of a recognized mediation center in India or a mutually agreed location.

  3. Arbitration
    If mediation fails to resolve the dispute, it shall be finally settled by arbitration under the following terms:

    • The arbitration will be conducted in accordance with the Arbitration and Conciliation Act, 1996 (India).

    • The seat and venue of arbitration will be Tamil Nadu, India.

    • The arbitration proceedings will be conducted in Tamil.

    • The decision of the arbitrator(s) will be binding and enforceable in any court of competent jurisdiction.

  4. Jurisdiction for Legal Proceedings
    If arbitration is deemed unenforceable or the dispute involves matters not eligible for arbitration, the courts in Tamil Nadu, India will have exclusive jurisdiction.

  5. Users Outside of India
    For users residing outside of India:

    • Local laws and regulations of your country may provide additional rights or obligations.

    • Any disputes or claims may also be subject to the laws of your jurisdiction.

  6. Class Action Waiver
    To the extent permitted by applicable law, you agree to waive any rights to participate in a class-action lawsuit or class-wide arbitration.

Exceptions

  • This dispute resolution process does not apply to claims for injunctive relief or other equitable remedies related to intellectual property rights, which may be brought in any competent jurisdiction.

By agreeing to these Terms, you acknowledge and accept that all disputes will be resolved through the mechanisms described above.
